    Mental Note: Never tell a cop that it doesnt matter what you are charged with because you have a good lawyer that will get you off.

    The judge wasnt too fond of that statement

    The actress immediately burst into tears after the ruling.
    Superior Court Judge Marsha Revel issued the sentence after listening to testimony from employees of an alcohol treatment program that Lohan had been ordered to attend.
    Lohan missed seven classes since December, which led to the judge's harsh rebuke of Lohan moments after the "Mean Girls" star offered a tearful apology.
    "I did do everything I was told to do and did the best I could to balance jobs and showing up," Lohan told the judge. "It wasn't vacation, it wasn't some sort of a joke."
    Revel said she found Lohan's apology insincere, comparing it to "somebody who cheats and thinks it isn't cheating if she doesn't get caught."
    Lohan was not immediately taken into custody and will be permitted to surrender on July 20. She will have to wear an ankle alcohol monitor until then.
    Los Angeles County district attorney spokeswoman Jane Robison said it was not uncommon for judges to allow defendants to turn themselves in at a later date so they can get their affairs in order.
    The sentence tripled the monthlong jail sentence prosecutors had sought for Lohan.
    It was unclear how much time Lohan will actually spend in jail. Los Angeles Sheriff's Department spokesman Steve Whitmore said female inmates convicted of nonviolent misdemeanors serve about a quarter of their sentence but that can be further reduced by state credits.
    Whitmore said Lohan might be released on house arrest, but it would depend on the specifics of Revel's order.
    Revel revoked Lohan's probation and ordered her to wear an ankle alcohol monitor after the starlet missed a court date in May. She was promoting a film project at the Cannes Film Festival at the time and claimed her passport was stolen.
    The monitor issued an alert after the actress attended the MTV Movie Awards and after-parties last month. Revel said the device registered a .03 blood alcohol level at the time. Lohan has denied drinking that night.
    Lohan's attorney, Shawn Chapman Holley, urged the judge to place the actress back on probation, saying she had learned her lesson and had improved.
    Prosecutor Danette Meyers disagreed and urged jail time for the star.
    "When you ordered her to go every week, it didn't catch her attention," Meyers said in a closing statement.
    Lohan spent 84 minutes in jail in 2007 after she pleaded guilty to two misdemeanor counts of being under the influence of cocaine and no contest to two counts of driving with a blood-alcohol level above 0.08 percent and one count of reckless driving.
    The plea came after a pair of high-profile arrests earlier that year. Lohan was sentenced to three years of probation but had to ask for a yearlong extension in October after she failed to complete her alcohol-education courses on time.

    Watching the video of this tells us all we need to know about LL. She is the type of person that loves to argue, and it looks like she was close to trying to argue with the judge a few times. Her body language and looks on her face tell me she has no real grasp of reality. She really needs to get some help, unfortunately the first step should be distancing herself from her mother

    So, she had one dui 3 years ago and they still want her to jump through hoops huh, looks like she's being made an example of because of her celebrity. California sure is a fucked up state, legalized pot, illegals everywhere, the state broke, and they want to make an example of a sweet girl who likes to party.

    No she didn't just have one DUI 3 years ago.. this girl has been in constant trouble the last 5-6 years... she is nothing but trouble... do a google and her history and she is lucky she is not under the jail... she makes Paris Hilton look like a nun

    Isn't most of the "trouble" directly related to this incident and the phony restrictions they want her to follow? For instance - she was supposed to refrain from drugs and alcohol as part of her sentence - since when do they make first time dui'ers have to jump through all these hoops?

    Ok dirty, I looked it up, it looks like she had 2 dwi problems(both in 2007) and since then every problem she has had is related to the ridiculous plea bargain she made that forced her to go to rehab, 36 months probation and refrain from drug and alcohol use for 18 months - which of course she cannot do and should never have agreed to. The courts fucked her over royally. There is no real reason she should be required to do anything at all related to testing/ abstention, etc.

    The reason she got punished so bad to start with is she was already in trouble and getting off because of who she was until she went up against a Judge who would make charges stick... She refused to cooperate after being given god knows how many chances... They threw the book at her then, let her out of a 30 day sentence after a hour and some change and put her on probation and then she fucks up at least once a month... if not for the law then their are pics in Tabloids every where drugged up or drunk and just flaunting it in the Judge's face... she got what we deserved.. If it were you or I we would be doing way more than 90 days (with 25% to serve) for all the things she had done.. more than one missed court mandated drug class and we would have been locked up for the rest of the sentence... she is still getting off light

    And First time DUI offenders in almost all 50 states require classes and/or some kind of Drug court (Classes once a week and court once a month) so they can track your progress... Standard issue now as they try to nip it in the bud as most who get one and get off light keep doing it over and over again... I know the Drug court DUI offenders have to go here in my town has cut DUI's by about 60% in the last 5 years... It works...

    The courts don't give a damn if she agrees to it or not.. it is not her decision... it is the Law and the Judges... in some states it is worse than that.. nowadays in Florida you lose your license for 6 months and get put thru the ringer.... GA is almost as bad... She got off light compared to todays DUI laws

    And lots of her problems with the courts are probably sealed as she got into some trouble when she was 16-17 years old and was a Juvenile.. this girl is messed up and deserves everything she gets... for her own good or she will be another tragedy like Andy Gibb and the many others who the law let slip thru the cracks because of who they were

    She should be allowed to drink at her choosing as well as do drugs if thats what she wants as long as she doesnt drive while doing it. I dont know what kind of messed up laws they have down south, but up here if you get a dui(and have any kind of decent lawyer) you will face a fine/ some kind of suspension and a n alcohol "evaluation" that most will completely lie at. Next door in Wisconsin the first dui isnt even a misdemeaner - its a traffic ticket with a small fine and zero consequences.

    We live in the Bible Belt... about 75% of the country have laws similar to ours... from Cali to the Norteast and thru the cornbelt and Tornado Alley.... they treat drunk drivers now worse than thief's, murderers, etc.... I am not saying she should be getting raked over the coals.... I am just saying with the laws the way they are now she is lucky and should be stopped before she gets worse as she has proven she is going to do...

    Naa, shes young rich and likes to party with others just like her - no chance she stops drinking or drugging as long as she spends her time in clubs - expecting her to is ridiculous. Now is it "bad" for her to live like she does, Of course it is, but she has the right to choose her own lifestyle(as long as she doesnt break any real laws).

    As far as dui laws go - pretty much everyone I know drinks and drives all the time - not a big deal - every bar I know has a parking lot full of cars and after closong they're almost all gone - I wonder who drove them home?

    I know one thing.. I got a DUI in 1996 and never again.. back then it was $1200 fine, 40 hours community service, Alcohol Evaluation and class (8 hours or 16 hours depending on evaluation), Loss of license for 3 months (work permit was given to drive back and forth to work), and then $350 to get your license back and a years probation or when you did your community service and paid your find it would be suspended...

    Now the laws are so tough If I have more than 4-5 beers I call a cab.. Never again will I get another... Stayed on my insurance until about 3 years ago.. I was paying over $1k every 6 months.. now I pay around $1200 a year on my vehicles... just not worth it

    She made an impassioned speech about taking responsibility for her life and respecting the authority of the court.
    But Lindsay Lohan was also apparently sending a message of her own to the judge who jailed her for 90 days and put her future career in jeopardy.

    The obscene message was clearly visible on the middle finger which was often pointed in the direction of Beverly Hills Superior Court Judge Marsha Revel.
    Profane: The gesture made a mockery of the 24-year-old's tearful plea that she was taking her court appearance seriously


    While the judge would not have been able to see the word from where she was sitting it was picked up by photographers who were allowed into the courtroom.
    The words had been painstakingly written in black over colourful nail polish.

    'I am not taking this as a joke. This is my life. It is my career. It is something I have worked for all my life,' the actress pleaded.
    'I don't want you to think I don't respect you and your terms.'

    Still, the star won't have time for profane manicures soon enough.
    She will have to surrender herself on July 20 to the Century Regional Detention Facility in Lynwood, Los Angeles.

    It is likely she will be placed in a special segregated cell for celebrities, however it is possible she will only serve 23 days behind bars due to overcrowding and the non-violent nature of her crime.
    The prison is the very same place where Lindsay served just 84 minutes three years ago before being released due to overcrowding.

    It is also where Lohan's former friend Paris Hilton spent several weeks the same year after violating her probation stemming from a driving under the influence arrest.

    The Century Regional Detention Facility holds 2,200 inmates and is located in the southern LA suburb of Lynwood.

    During her time behind bars, Lohan will spend 23 hours a day in a two-bunk cell with a toilet and sink and will be given an hour a day to shower, watch television, exercise outside and make phone calls.
    The Mean Girls star was visibly stunned yesterday when Superior Court Judge Marsha Revel handed down the term and blasted her for not taking her probation in two 2007 drink-driving cases seriously.

    Lohan's lawyer urged the judge not to punish her too severely because she 'did the best she could under extremely difficult circumstances'.
    After being handed her sentence, the devastated star briefly covered her face with her lawyer's notes, which listed excuses for why she missed some of her classes.
    Lohan was on probation after two DUI offences in less than two months in 2007.
    On May 26, 2007, the actress was in a Mercedes-Benz that crashed into a hedge along Sunset Boulevard.
    Lohan protested she did not realise she had not been keeping up with the court ordered alcohol education classes and insisted a busy work schedule had stopped her attending regularly.

    But the judge was insistent, saying: 'I couldn't have been more clear [about my orders]. There are no excuses.'
    The Beverly Hills court heard Lohan repeatedly missed once-weekly classes at an alcohol-education programme.
    Lohan had failed to attend the course at least nine times since October 16, the court heard.
    Her lawyer Shawn Chapman Holley claimed Lohan had done well by meeting the overall terms of her probation.
    Less than two months later she was arrested in Santa Monica on suspicion of drink-driving.

    Lohan later pleaded no contest to two counts each of drunken driving and being under the influence of cocaine, and one count of reckless driving.
    She spent just 84 minutes in Lynwood in November 2007 due to overcrowding and was placed on three years' probation.
    Lohan's probation was extended for a year in October after she missed some alcohol-education classes while making a movie in Texas.
    In May she failed to show up for a court hearing because she was at the Cannes Film Festival.
    Her legal team claimed she was stranded in France after her passport was stolen.

    Lohan eventually made it to court four days late, when she was ordered to wear a Scram alcohol-monitoring ankle bracelet as a condition of her release on bail pending Tuesday's probation hearing.

    On June 6 the bracelet indicated Lohan may have violated her bail by consuming alcohol after the MTV Movie Awards.
    The judge doubled Lohan's bail and the actress posted a bond with the court, allowing her to remain out of custody.
    At yesterday's hearing, Revel did not consider the Scram anklet as part of her determination of whether Lohan violated probation.

    The judge conceded Lohan was ordered to wear the device as a condition of her bail when she appeared in court in May, not when she was placed on probation.
    She was sentenced to 30 days in jail for the reckless driving case, 30 days consecutive for the first DUI case and another 30 days consecutive for the second drink-driving case.
    Lohan must not drink any alcohol as a condition of her continuing probation.
    Her estranged father Michael, with his lawyer Lisa Bloom, and the actress's sister Ali, 16, were both in the court.
    Her mother Dina Lohan was noticeably absent, but was seen arriving at her daughter's LA apartment today.




    Two weeks of freedom: Lindsay, who left in a different outfit after changing half way through proceedings, will start her sentence on July 20




    And her rumoured new girlfriend Eilat Anschel, who recently completed a mandatory stretch in the Israeli Army, was also spotted by onlookers.
    After leaving court, her father Michael appeared on Larry King Live to speak of his 'dismay', but 'satisfaction' over his daughter's sentencing.
    He said: 'I feel dismay, but at the same time a little satisfaction that she's going to rehab. But the last thing in the world I wanted was for my daughter to go to jail.
    As Lindsay went home and requested friends to visit her on her Twitter page, her father was later spotted out partying at The Saddle Ranch on Sunset Boulevard.

    I think she will only serve 30 days max in jail......Already too much overcrowding in California's jails. Plus she probably wont be with the general population because of her celebrity status.
